Children Under the Age of 18

Our Services are not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Services. We do not knowingly collect personal information from children under 18.   • Information that you provide by filling in forms on our Services, including information provided at the time of registering for an account, enrolling in our supply program, placing an order, or requesting further services. We may also ask you for information when you report a problem with the Services.

  • Details of transactions you carry out through our Services and of the fulfillment of your orders. You may be required to provide financial or insurance information before placing an order.
  • Your search queries on the Services.

Disclosure of Your Information

We may disclose aggregated or de-identified information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or that you provide as described in this privacy policy:

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To enforce or apply our terms of use or terms of sale and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We do not sell your personal information, and we do not share personal information with third parties for their own direct marketing purposes.

Data Retention

We retain your personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide our Services to you, to comply with our legal, regulatory, tax, accounting, and reporting obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by the type of information:

  • Account information. Information associated with your user account (such as your name, contact details, and login credentials) is retained for as long as your account remains active. If you close your account or request deletion, we will delete or de-identify this information within 60 days, except as described below.
  • Order, transaction, and delivery records. Records relating to orders, billing, claims, and proof of delivery are retained for 7 years from the date of service, as required by Medicare supplier standards and other applicable federal and state laws.
  • Health information. Health information submitted in connection with your care and orders is retained in accordance with applicable federal and state healthcare recordkeeping requirements, generally for a period of 7–10 years, and longer where required by law.
  • Correspondence and customer service records. Retained for [X] years from the date of the communication.
  • Automatically collected information. Usage logs, IP addresses, and similar technical data are retained for up to 18 months, after which they are deleted or aggregated so that they no longer identify you.

When personal information is no longer required to be retained, we delete it or de-identify it in accordance with our internal data disposal procedures.

Deleting Your Information and Your Account

You may request deletion of your account and associated personal information at any time by:

  • Using the account deletion option within the App;
  • Visiting [URL of web-based account deletion request page]; or
  • Emailing us at info@encoresurgicalsupplies.com with your request.

When you delete your account, we will delete or de-identify your personal information within 60 days, except that we may retain information where we are required or permitted to do so by law — including order, billing, claims, delivery, and health records subject to the retention periods described above — or where retention is necessary to resolve disputes, prevent fraud, or enforce our agreements. Information retained for these purposes will be used only for those limited purposes and protected in accordance with this policy.

Please note that we cannot delete personal information that we are legally required to retain, and deleting your account does not remove information from records maintained by your healthcare providers, facilities, or insurers.

Data Security

We have implemented administrative, technical, and physical safeguards designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include encryption of data in transit and at rest, access controls limiting information to personnel who need it, and regular review of our security practices.

The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of our Services, you are responsible for keeping that password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
